BAM HIGH FIVE PROMOTION – OFFICIAL TERMS & CONDITIONS

  1. PROMOTION OVERVIEW AND ENTRY METHODS

The BAM HIGH FIVE promotion (“Promotion”) is a referral-based incentive sweepstakes administered by Multibrain Network, Inc. Eligible participants may enter by (1) completing a Qualified Referral via a paid BAM Pro subscription or (2) submitting a free alternate entry by mail, as described below.

No purchase or payment is necessary to enter or win. A purchase will not increase your chances of winning. This Promotion is subject to the eligibility requirements and restrictions outlined herein and is void where prohibited by law.

This Promotion is void where prohibited by law, and it is the participant’s responsibility to verify eligibility under local laws.

  1. DEFINITIONS
  • “Sponsor”: Multibrain Network, Inc., administrator of the BAM platform and this Promotion.
  • “Participant”: Any individual who registers for the Promotion while holding an active BAM Pro subscription.
  • “Referrer”: An existing BAM Pro subscriber who shares their unique referral link.
  • “Referee”: A new user who signs up using the Referrer’s link for a discounted BAM Pro subscription.
  • “Qualified Referral”: A referee who (a) has not had a BAM Pro subscription within the past 12 months; (b) uses a unique email and payment method; and (c) successfully purchases an annual BAM Pro subscription through a referral link.
  • “Cycle”: A period that ends once 500 Qualified Referrals have been received under this Promotion.
  • “Entry”: A valid chance to win, earned when a Qualified Referral is completed.
  1. ELIGIBILITY

This Promotion is open only to individuals who:

  • Are legal residents of the United States (including D.C.);
  • Are 18 years of age or older at time of entry;
  • Maintain an active, fully paid BAM Pro subscription throughout the referral cycle and at the time of drawing;
  • Have not been a BAM Pro subscriber in the 12 months prior to being referred;
  • Are not employees, contractors, officers, agents, or affiliates of Multibrain Network, Inc. or any of its subsidiaries or partners;
  • Are not immediate family or household members of the aforementioned parties.

Participation is void where prohibited by law. This Promotion complies with applicable prize value reporting thresholds. Residents of New York, Florida, and Rhode Island may be subject to additional state-specific limitations. Sponsor reserves the right to verify participant eligibility at any time.

  1. PROMOTION PERIOD AND CYCLES

The Promotion begins on July 1, 2025, and will continue until terminated by the Sponsor.

  • Each Cycle is completed upon the accumulation of 500 new Qualified Referrals.
  • A new Cycle begins automatically after each completed one.
  • The Promotion may run for an unlimited number of Cycles unless terminated by the Sponsor.
  1. HOW TO PARTICIPATE
  1. Visit https://mybam.app/highfive and register using your BAM Pro account.
  2. Receive a unique referral link tied to your account within 72 hours.
  3. Share your referral link with as many individuals as you wish. There is no cap on the number of referrals.
  4. For each Qualified Referral, both the Referrer and the Referee receive one Entry into the current Cycle’s prize drawing.
  5. Entries are valid only within the Cycle in which they are earned. They do not roll over.

Entries are non-transferable, have no cash value, and may not be sold, bartered, or assigned to any other user or account. Referral link delivery and functionality may be delayed due to platform volume, technical issues, or account review. Sponsor does not guarantee uninterrupted access to referral features.

5A. ALTERNATIVE METHOD OF ENTRY


To enter the Promotion without a BAM Pro subscription, participants may submit a mail-in entry as follows:

Handprint your full name, complete mailing address, valid email address, phone number, and the words “BAM HIGH FIVE Entry” on a plain 3″ x 5″ card and mail it in a standard envelope to:

Mail-in entries must be postmarked during the applicable Cycle and received within 7 calendar days of that Cycle’s end to be eligible for that Cycle’s drawing.

Limit one (1) mail-in entry per person, per Cycle. Entries must be submitted individually. Bulk or mechanically reproduced entries will not be accepted. Illegible, incomplete, or late entries will be disqualified.

  1. PRIZE STRUCTURE

At the end of each Cycle:

  • One Referee will be randomly selected from among all eligible entries.
  • The Referrer who referred that Referee will also be declared a winner.
  • Each will receive a $500 check (USD).

The odds of winning depend on the total number of eligible Entries received during the applicable Cycle.

Sponsor reserves the right to verify the identity and eligibility of winners before awarding prizes. Sponsor reserves the right to substitute any prize for one of equal or greater value in the event of unavailability due to circumstances beyond its control.

  1. NOTIFICATION AND DELIVERY OF PRIZES
  • Winners will be notified by email within 7 business days of a Cycle closing.
  • Winners must respond and complete any requested documentation within 10 business days, including providing a valid IRS Form W-9 if applicable.
  • Prizes will be mailed within 30 calendar days of confirmation.

Sponsor is not responsible for delayed, lost, misdirected, or undelivered notifications or prize checks.

  1. TAXES AND IRS REPORTING
  • Winners are responsible for any and all taxes resulting from prize acceptance.
  • Prizes over $600 annually will require the submission of an IRS Form W-9 and will be reported via Form 1099-MISC.

Failure to provide tax documentation within 10 business days may result in forfeiture of the prize.

  1. REFUND AND ROLLBACK POLICY

Subscriptions purchased through a referral link under this Promotion are non-refundable once a referral has been credited and an Entry earned.

If a referred user cancels, disputes, or requests a refund for their subscription, their Entry—and that of the Referrer—will be disqualified.

  1. ANTI-FRAUD AND MISUSE POLICY

Sponsor reserves the right to monitor participation and disqualify any user or account for:

  • Creating or controlling multiple accounts;
  • Using bots, scripts, automated systems;
  • Referral rings or collusion with friends/family;
  • Submitting false or unverifiable referrals ;
  • Abusing refunds or manipulating subscription status.

Sponsor may revoke Entries, deny prizes, suspend accounts, or terminate Promotion access.

  1. INACTIVITY, CANCELLATION & ENTRY FORFEITURE

Participants must retain an active, fully paid BAM Pro subscription at the time of drawing. If either party (Referrer or Referee) cancels, downgrades, or fails to maintain payment, all related Entries will be voided.

  1. AUTO-RENEWAL DISCLOSURE

BAM Pro subscriptions renew automatically on an annual basis. By purchasing, you agree to this auto-renewal. You may cancel auto-renewal at any time via your account settings. Cancellation of the subscription prior to a prize drawing will render associated Entries ineligible.

This disclosure complies with state consumer protection laws, including California’s Automatic Renewal Law (ARL).

  1. SYSTEM FAILURES & TECHNICAL ISSUES

In the event of downtime or technical error:

  • Referrals and entries may be delayed.
  • The current Cycle will resume when systems are restored.
  • Sponsor is not liable for unprocessed Entries or disrupted user access during downtime.
  1. CANCELLATION OR MODIFICATION OF PROMOTION

Sponsor reserves the right to modify, suspend, or terminate the Promotion or its rules at any time, for any reason, including fraud, legal compliance, or operational needs. Changes will be posted publicly on BAM’s website and/or via in-app notification.

  1. PRIVACY AND DATA HANDLING

Your personal information is collected, stored, and used in accordance with the BAM Privacy Policy.

  • Information is stored on U.S.-based servers and is subject to applicable data protection laws.
  • Participation constitutes consent to the use of your name, contact information, and prize-related data for Promotion administration.
  1. EMAIL, PUSH & PROMOTIONAL COMMUNICATIONS

By entering, you agree to receive promotional communications from BAM regarding the Promotion and future offerings. You may opt out at any time via your account settings or by contacting support.

Opting out before the end of a Cycle may result in forfeiture of eligibility.

  1. RIGHT TO PUBLICITY

Except where prohibited, winners grant the Sponsor the right to use their name, photo, likeness, city and state for publicity and marketing purposes without additional compensation or notification.

  1. SEVERABILITY

If any provision of these Terms is deemed unlawful or unenforceable, it will not affect the validity of remaining provisions.

  1. GOVERNING LAW AND DISPUTE RESOLUTION

This Promotion is governed by the laws of the State of California, without regard to conflict-of-law rules.

  • All disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
  • By participating, you waive the right to a jury trial and agree to resolve disputes individually, not as part of a class action.
  • At Sponsor’s sole discretion, any disputes may be resolved exclusively through final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.
  1. PLATFORM DISCLAIMER

This Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Apple, Google, or any other platform or third-party service provider used to promote or distribute the campaign.

  1. ENTIRE AGREEMENT

These Terms & Conditions, along with the BAM Terms of Service and Privacy Policy, constitute the full legal agreement governing participation in this Promotion. No oral agreements or representations will be binding.
